Principle of mutual recognition on Food Contact Materials designed to European Market 1935/2004

As explained in other chapters, for materials designed to food contact having an harmonized european legislation, the compliance must be established satisfing the requirements of that legislation. In other cases, for materials that have NOT an harmonized legislation, each european nation could have a specific national law that must be respected (i.e. Italy provides specific requirements for stainless steel articles designed to contact food substances).

In this case, the evaluation of products could be subjected to the PRINCIPLE OF MUTUAL RECOGNITION.

This principle allows the importation of a specific product, just legally marketed in a Member State, in another Member State even if this product does not comply with the requirements established in this second State.

This means that, Member States, should allows the free circulation of products suitable to principle of mutual recognition, unless they are able to demonstrate, following specific procedure, that it could be dangerous to public health.

Support about the use of principle said above,in the food contact materials field,could be find in the European Council resolution dated 28 October 1999. In this, the Council promotes fully the use of mutual recognition principle.
